Dancify – Terms of Service

1. Introduction

Welcome to Dancify ("Platform", "we", "us", "our"). By accessing or using our website and services, you ("User", "you", "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Platform.

Dancify provides an AI-powered video generation service that allows users to create short-form video content ("Reels") from uploaded image inputs.

2. Eligibility

You must be at least 18 years of age to use this Platform.

By using the Platform you confirm that you are of legal age in your jurisdiction.

We reserve the right to request age verification at any time and to suspend accounts that violate this requirement.

3. Account & Coins

• Access to video generation requires an account and sufficient coin balance.
• Coins are purchased via cryptocurrency payment and are non-refundable once credited to your account.
• Coins have no cash value and cannot be transferred, sold, or exchanged outside the Platform.
• We reserve the right to modify coin pricing at any time. Existing balances remain unaffected.
• You are responsible for maintaining the security of your account credentials.

4. Acceptable Use & Image Upload Policy

This is critical. By uploading any image to Dancify you represent and warrant that:

• You own the image or have obtained explicit, documented consent from the person depicted to use their likeness for AI-generated video content.
• The image does not depict any person under the age of 18.
• The image does not contain illegal content, including but not limited to child sexual abuse material (CSAM), non-consensual intimate imagery, or content that violates any applicable law.
• You have not obtained the image through theft, hacking, scraping, or any unauthorized means.

Strictly prohibited:

• Uploading images of any person without their explicit consent for AI video generation.
• Generating content intended to harass, defame, blackmail, extort, or harm any individual.
• Creating deepfake content designed to deceive, defraud, or impersonate any person for malicious purposes.
• Generating content depicting or simulating minors in any context.
• Using the Platform for any activity that violates local, national, or international law.

Violation of these rules will result in immediate account termination without refund and may be reported to the relevant authorities.

5. Content Ownership & License

• Your inputs: You retain ownership of any images you upload.
• Generated outputs: You are granted a personal, non-exclusive, non-transferable license to use the AI-generated videos for lawful personal use.
• Our license: By uploading content you grant Dancify a limited, temporary license to process your image solely for the purpose of generating your requested video. We do not use your uploads to train AI models.
• No resale: You may not resell, sublicense, or commercially redistribute generated videos unless explicitly agreed upon in a separate licensing arrangement.

6. Data Handling & Privacy

Uploaded images are processed through third-party AI infrastructure. We maintain a Data Processing Addendum (DPA) with our AI provider to ensure your data is handled as a processor, not used for model training.

Deletion policy: Uploaded images and generated videos are deleted from our processing servers after delivery. You may request deletion of any stored data, which will be completed within 30 days.

We store only the minimum data necessary for account management and transaction records.

We do not sell your personal data or uploaded content to third parties.

7. Payments & Refunds

• All payments are processed via cryptocurrency. Transactions on the blockchain are irreversible.
• Coins are credited upon confirmed payment via webhook verification.
• No refunds will be issued for purchased coins, except where required by applicable law.
• If a video generation fails due to a platform error, the coins spent will be re-credited to your account.

8. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee:

• Uninterrupted or error-free service.
• Specific quality, accuracy, or appearance of generated videos.
• That generated content will be suitable for any particular purpose.

9. Limitation of Liability

To the maximum extent permitted by law, Dancify and its operators shall not be liable for:

• Any indirect, incidental, special, or consequential damages arising from your use of the Platform.
• Any loss resulting from unauthorized use of your account.
• Any damages resulting from third-party actions, including AI provider outages or errors.
• Any legal consequences arising from your misuse of the Platform or violation of these Terms.

You are solely responsible for the content you upload and the videos you generate.

10. Indemnification

You agree to indemnify, defend, and hold harmless Dancify, its operators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms.
• Your infringement of any third party's rights, including privacy, publicity, or intellectual property rights.
• Any content you upload or generate through the Platform.

11. Content Moderation & Enforcement

• We reserve the right to review, flag, or remove any uploaded or generated content at our sole discretion.
• We may implement automated content-safety filters. Attempts to bypass these filters are a violation of these Terms.
• We cooperate with law enforcement when required by law or when we identify content involving minors or criminal activity.

12. Termination

• We may suspend or terminate your account at any time, with or without notice, for any violation of these Terms.
• Upon termination, your coin balance is forfeited and no refund will be issued.
• You may delete your account at any time by contacting us. Upon deletion, all associated data will be removed within 30 days.

13. Modifications

• We reserve the right to update these Terms at any time. Changes become effective upon posting.
• Continued use of the Platform after changes constitutes acceptance of the updated Terms.
• Material changes will be communicated via the Platform or email where possible.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Dancify operates. Any disputes shall be resolved in the competent courts of that jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full effect.
